1 Acceptance of Terms

By downloading, installing, or using LowLighter ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. These terms constitute a legally binding agreement between you and LowLighter.

2 Description of Service

LowLighter is a desktop application for Windows and macOS that provides an AI-powered overlay interface. The App allows users to:

  • Select regions of their screen to analyze
  • Receive AI-generated answers, explanations, summaries, and translations
  • Customize the appearance and behavior of the overlay

3 Account Registration

To access certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4 Subscription & Billing

Free Trial: New users receive 5 free Vision responses. No credit card is required for the trial.

Paid Plans: We offer Basic and Pro subscription plans billed monthly or annually. Prices are displayed at checkout and may change with notice.

Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings or Stripe billing portal.

Refunds: We offer refunds on a case-by-case basis. Contact support within 7 days of purchase for refund requests.

5 Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Attempt to reverse engineer or modify the App
  • Interfere with or disrupt the service
  • Share account credentials with others
  • Use automated systems to abuse usage limits

⚠ User Responsibility & Prohibited Use

LowLighter is a productivity tool designed for legitimate use. You are solely responsible for how you use this App and any consequences arising from its use.

Strictly Prohibited:

  • Academic Dishonesty: Using the App to cheat on exams, tests, assignments, or any form of academic assessment. This includes but is not limited to using the App during proctored exams, completing homework dishonestly, or violating your educational institution's academic integrity policies.
  • Certification Fraud: Using the App during professional certification exams, licensing tests, or any assessment where external assistance is prohibited.
  • Violation of Testing Rules: Using the App in violation of any testing environment's rules, terms, or policies, including online proctoring systems.
  • Fraudulent Activities: Any use of the App to commit fraud, deception, or misrepresentation in any context.

⚠️ IMPORTANT: PHANTOM MODE DISCLAIMER

Phantom Mode, GhostKeys, Stealth Type, and related features are designed for legitimate privacy and productivity purposes only — such as protecting sensitive work information during screen shares, demonstrations, or recordings. These features are NOT intended for, and must not be used for, cheating, academic dishonesty, exam fraud, or any deceptive purpose. Misuse of these features is a violation of these Terms and may result in immediate account termination without refund.

Legal Disclaimer & Limitation of Liability:

YOU ACKNOWLEDGE AND AGREE THAT:

  • • You are solely responsible for compliance with all applicable laws, regulations, and institutional policies
  • • LowLighter is not responsible for any violations of academic integrity policies, honor codes, or testing rules
  • • If you are caught cheating or violating rules while using this App, LowLighter bears NO liability for any consequences including but not limited to: academic penalties, expulsion, loss of credentials, legal action, or reputational harm
  • • LowLighter does not endorse, encourage, or facilitate cheating or any form of academic dishonesty
  • • The App's features (including Phantom Mode) are provided for legitimate productivity purposes only
  • • By using this App, you release LowLighter from all liability arising from your misuse of the App

LowLighter reserves the right to immediately terminate accounts suspected of prohibited use without refund. We may cooperate with educational institutions and legal authorities in investigations of misuse.

6 Intellectual Property

The App, including its code, design, features, and content, is owned by LowLighter and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business purposes in accordance with these terms.

7 Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, secure, or available at all times. AI-generated responses are for informational purposes only and should not be relied upon for critical decisions without verification.

8 Limitation of Liability

To the maximum extent permitted by law, LowLighter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9 Termination

We may suspend or terminate your access to the App at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

10 Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the new terms.

11 Indemnification

You agree to indemnify, defend, and hold harmless LowLighter, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third party's rights, including intellectual property rights; or (e) any claim that your use of the App caused damage to a third party. This indemnification obligation will survive termination of these Terms and your use of the App.

12 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in California.

CLASS ACTION WAIVER

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you and LowLighter each waive any right to a jury trial. You also waive any right to participate in a class action lawsuit or class-wide arbitration.
